Disability Element - Working Tax Credit

The Disability Element of Working Tax Credit is extra money that is paid through tax credits to people with a disability who are working.

To get the Disability Element of working Tax Credits:

  • You have to be working at least 16 hours per week; and

  • You have to have a disability that means you are treated as a disadvantaged worker; and

  • You have to be receiving a qualifying benefit. For most claims, the qualifying benefits are Personal Independence Payment (PIP), Disability Living Allowance (DLA), Attendance Allowance or Armed Forces Independence Payment (AFIP). If you think you are at a disadvantage in getting a job but you aren’t getting any of these benefits, you should speak to an adviser. This is because there are some cases when you can get the Disability Element without getting any of these benefits.

If you live with a partner, you can only get a Disability Element in your tax credits award if the partner with a disability is working at least 16 hours per week.

If you live with a partner and you both satisfy the requirements for the Disability Element, you can get two Disability Elements in your award.
